	Arts Makers / Kāhui Ringatoi Aotearoa (AMA) believes in the power of arts, culture and creativity to enrich the lives of all New Zealanders. AMA aims to raise the standard of support for visual artists and the arts sector as a whole. It is time for art makers to shape the policies that directly affect our arts communities, work and wellbeing.
Since 2020, AMA has become an established advocacy network tuned into the discussions taking place amongst our extended whānau, friends and peers. We hear the widespread frustration that our creative community feels and use this knowledge to inform the trajectory of our work directly.
 
The current state of affairs is impacted by the threat to arts funding and the bias in society in undervaluing art and artists. AMA has contributed to the campaign for Resale Royalties in the secondary market and has created the first set of guidelines on Artist Fees in Aotearoa, New Zealand. Arts Makers Aotearoa has identified the need for a diverse collective of makers to self-organise and create initiatives that can sustain the members of our creative community. We believe that working together is the surest path to meaningful change and radical imaginaries.

	Arts Makers Aotearoa was founded in 2020 by  Heidi Brickell, Judith Darragh, Mark Harvey, Rebecca Hobbs, Roxanne Hawthorne and Richard Orjis.
Through arts funding Sophie Sutherland and Natasha Matlia-Smith were previously employed as Project Managers / Administrators delivering AMA’s founding mahi. And ngā manaakitanga to recently departed board member Siân Quennell Torrington, and designer Roxanne Hawthorne who spearheaded AMA’s online presence + print projects from 2020-25.
 
The current AMA board is made up of Judith Darragh, Zoe Black and Victoria Walsh, donating their time in advisory roles, and Claudia Jowitt as Project Manager / Administrator with CNZ funding.




	&#38;nbsp; Judith Darragh ONZM &#38;nbsp;
Judith, exhibits throughout Aotearoa and is renowned for her sculptural assemblages, collage, photography, video, and poster art — with many works held in public collections. Alongside co-editing Femisphere, a zine / publication supporting women’s art practice Judith was central to the development of Artspace Aotearoa, as well as artist-run spaces Teststrip, and Cuckoo. Judith has also been an educator, and mentored many artists over the past 30 years.

	&#38;nbsp; Zoe Black &#38;nbsp;Zoe, Ngāpuhi, Ngāti Hine, Pākehā, is the deputy director of Objectspace in Tāmaki Makaurau. Her curatorial practice has focussed on community development and advocating for critically underrepresented craft and object art forms. She is currently Norwegian Crafts’ Curator in Residence, working on projects that create a dialogue between Indigenous making practices in Aotearoa and Sápmi.



	&#38;nbsp; Victoria Walsh &#38;nbsp;

Victoria, originally from Nova Scotia, is a dedicated advocate for the creative sector in Aotearoa. She focuses on mobilising and empowering creative communitites, with a strong commitment to te ao Māori and mana motuhake for Indigenious practitioners. In 2003, Vic played a pivotal role in the Stop the Cuts campaign, opposing the Auckland Council’s proposed $36.5M cuts to arts funding. Her work centres on supporting creatives and advoating for systems that uplift cultural sovereignty and artistic sustainability.
	&#38;nbsp; Claudia Jowitt &#38;nbsp;

Claudia is an artist, educator, administrator and creative advocate of Pākehā and iTaukei (Fijian) heritage. She has a MFA from Elam, a BArtDes (Hons) and BVA from AUT. She been exhibiting both nationally and internationally since first completing her undergraduate degree in 2009. Jowitt has a breadth of experience working in the arts sector and is passionate about both supporting representation of Pacific peoples in the arts and creating professional development resourcing for artists.

	AMA advocates for the value of artists and art in the form of more paid roles in the arts and less unpaid, volunteer based internships. We want to help Aotearoa come into step with international best practice.The art industry has relied on the backbone of volunteer time and we must fight for this labour to be paid and valued in a way that will create more jobs and better quality of life for the creative community. Creative New Zealand advises that art workers and practitioners are paid a minimum of $30 per hour.Fair remuneration means pay rates for more experienced artists or art practitioners should be at a level above or well above the minimum wage, be in line with their skills and experience, and recognise the duration or nature of the project (e.g. contract work).

	&#38;nbsp; Artist Fee Guideline &#38;nbsp;

	An artist fee is understood as compensation for content and services provided by artists to publicly funded galleries.

The artist fees below provide a guideline for consideration to ensure a minimum for fair and reasonable payment and understand that every exhibition, artist and context is different. The rates will change with annual future inflation and community consultation.

	The figures were created in consultation with people from the visual art sector, including independent creative practitioners, Arts Makers Aotearoa members, the Aotearoa Public Gallery Directors Network (APGDN),










Dignity and Money Now&#38;nbsp;(D.A.M.N.) and in reference to international precedence set by Working Artists and the Greater Economy (W.A.G.E, United States) and the National Association for Visual Artists (NAVA, Australia).

Taken as a minimum payment standard, the compensation floor is appropriate for smaller government funded organisations with limited means but inappropriate for those with larger budgets that can afford to pay higher fees. We understand that some self-funded artist-run spaces are not in a financial position to provide an artist fee. We encourage them to make this transparent to prospective artists and endeavour to apply for future funding to cover artist fees.

Although distinct from the artists’ fee guidelines, AMA takes the position that galleries should cover or assist artists with production costs. Alternatively, galleries should lead or collaborate with the artists to seek external funding to cover these costs.

	&#38;nbsp; Artist Fee&#38;nbsp;&#38;nbsp;











An artist fee is compensation for time-limited content and services provided by artists to public art organ-isations as contracted by galleries in the course of mounting programmes, as defined by their mission. 
An artist fee is not intended as compensation for the labour or materials of making art but is the expected remuneration for an artist’s temporary transactional relationship with an institution to provide content. Payment is not for the content itself but for its provision. 


The artist fee is distinct and separate from basic programming costs and services, production expenses, and the purchase of artworks or copyrights. Payment of an artist fee does not imply the transfer of ownership or rights from the artist to the organisation. Any transfer of ownership or rights must be negotiated between the artist and the organisation under a separate agreement.



&#38;nbsp;&#38;nbsp;Artist &#38;nbsp;










‘Artist’ refers to all those who supply content and services in an art gallery presenting context, including visual artists, performers, dancers, poets, filmmakers, writers, and musicians, among others. It does not distinguish between individual and collective / collaborative providers of content and services. All are covered under the term ‘artist.’

	&#38;nbsp;&#38;nbsp;Basic Programming Costs &#38;nbsp;










An artist fee is distinct and separate from basic programming costs and services. Basic programming costs are the costs associated with the basic require-ments of mounting programmes as defined by the organisation’s mission and are irrespective of specific content. These basic requirements also constitute the basic programming services an organisation must provide to artists in mounting programmes.
The provision of basic programming costs and services include: &#38;nbsp;
Provision of exhibition, performance, 
or projection space
Preparation of exhibition, performance,
or projection space for the programme&#38;nbsp;
Shipping and insurance costs when necessary&#38;nbsp; Presentation infrastructure, including display equipment, exhibition furniture and lighting
Documentation of exhibition or event
Promotion of exhibition or event&#38;nbsp;
Travel and accommodation when necessary
Obtaining and paying for image rights for commissioned and existing text











&#38;nbsp; Production Costs &#38;nbsp;
Production costs are also distinct and separate from basic programming costs and services and investments an organisation may make in display equipment or exhibition furniture in conjunction with the presentation of a specific programme where these remain the organisation’s property. 
The organisation may negotiate reimbursement of production expenses if the work is sold subsequent to exhibition.

Specialised installation expenses above and beyond basic programming costs and services
Studio rental Equipment rental
Subcontracted labour by graphic designers, fabricators, performers, lighting designers, etc.&#38;nbsp;












The coverage of production costs by the organisation is not required; however, organisations may not reduce or omit artist fees in connection with the coverage of production costs. Production costs and artist fees constitute separate and distinct line items in the exhibition and operating budgets.

&#38;nbsp;&#38;nbsp;Public Art Galleries &#38;nbsp;Government-run galleries, independent government-funded galleries, council-run galleries, and independent council-funded galleries.











Public galleries cover a wide range of exhibition spaces. They do not process the sale of artwork but often have a gallery shop where merchandise, books and prints are available. Public galleries often have collections and exhibit historical or themed exhibitions showcasing these collections. Some public galleries focus on curated exhibition programs, working closely with the artist(s) during the show’s development. In the case of extensive public galleries, a combination of these two styles can occur. Public galleries usually provide an artist fee to the creatives who provide content for the exhibitions. Artists do not rent these spaces. The artists involved sign contractual agreements to exhibit. Exhibition programmes are developed in advance through curatorial decisions or formal proposals. This process relies on the curatorial team of each gallery and responds to the various requirements prioritised by management and programme policies. 





&#38;nbsp; Community Gallery &#38;nbsp;Community galleries serve their community by providing gallery members of the local community opportunities to exhibit and sell work. There is often a commission on sales. Community galleries maximise their space by having a shop-style gallery for people to browse and buy art easily. Some of these galleries will take a commission on the sales of work. It should be outlined in a contract before the show’s installation.


	&#38;nbsp; Artist-Run Spaces &#38;nbsp;Artist-run spaces are galleries organised and directed by an artist or group of creatives. They are usually self-funded by the organisers or depend on funding from government funding bodies such as Creative New Zealand. Artist-run spaces are alternative exhibition spaces to mainstream galleries and will often encourage emerging artists and experimental art projects. They do not usually process the sale of work but can partake in fundraising events or art fairs. Artist-run spaces offering an artist fee depends on whether they receive funding and decisions made by the organising team. Exhibitions are not often curated but go through a proposal process. This process asks for proposals from individual artists, groups, or curators proposing new work or projects. There are usually one or two calls for proposals throughout the year, whereby the organising group collectively decides on the exhibition program for the upcoming year based on the proposals offered.


&#38;nbsp; Art Museum &#38;nbsp;Art Museums do collect art. They often have historic shows based on their collection. These show are curated, but Art Museums only sell work for a particular event, such as a fundraiser.

Dealer or Commercial galleries are spaces run by a gallerist or dealer who buy and sell artwork. They have access to an extensive network of collectors and institutions. Dealer galleries often work with select artists depending on their styles and aesthetic tastes. In exchange for commission (a percentage of the artworks sold), the dealer commits to supporting their artists through networking, showcasing, promoting and selling artworks. These galleries take a commission of around 40-50%.



&#38;nbsp;&#38;nbsp;Informal Cooperative&#38;nbsp;&#38;nbsp;










Informal cooperatives are similar to Dealer or Commercial galleries. Rather than one gallerist who runs the space, an informal cooperative is run by a collective that makes decisions as a group and acts as a board for the business. The gallery deals with sales, media promotion, advertise-ment, and choosing the artists to show. They also take a commission on sales, usually 40%. They do not function through a call-for-proposal system.



&#38;nbsp;&#38;nbsp;Vanity Art Gallery / Rental Gallery&#38;nbsp;&#38;nbsp;





















Vanity galleries are spaces where artists pay to rent either wall space or the entire gallery to show their work for a specific time and sell work. Vanity galleries offer their support in helping to promote the artist and the event of the show and will process the sale with a variable commission rate.

	There are so many styles of contracts, some contracts if you are working with a gallery as an artist are very informal and trust based. If you are signing a contract, make sure to read it through thoroughly as it is legally binding.

	The work you will be getting paid to do and how you will be getting paid
What you are expected to do — services that you will provide
Where you will deliver these services e.g. at home or a different location
How much you will be paid, and when to invoice for this (weekly, monthly, or after certain tasks or projects have been completed)
	How many hours you’ll work per day / week / month — this could be a range e.g. up to 25 hours per week — and when you’ll work them, e.g. on weekdays between 9am to 5pm

How long the contract will last — also called its ‘term’ — and whether it can be renewed

What expenses or allowances you’ll be paid, e.g. will you be reimbursed if you use your own car or your own tools, will you be reimbursed for food and accommodation if you travel
	Who will your client contact person will beWhether either party has the right to terminate the contractHow disputes will be resolved — when you’re a contractor you can’t raise a personal grievance if you and a client you work for have a disagreementWho will own any intellectual property that you may have developed as part of the contract

If you are an artist working individually with or without a dealer the best way to manage your tax is through being a sole trader. Sole traders are people who work for themselves, contract out their services or have a small business where they are the sole member.You do not have to register with a government agency to become a sole trader and unless you make over $60,000 per year you do not need to be GST registered.Record keeping is key and will allow you to claim back on business expenses and lower the amount of tax you have to pay at the end of each year. Keep GST receipts and a book or leger of what you buy for your business. For example, if you work from home or use the internet for your work a percentage of rent and bills can be claimed back as business expense. 
As a sole trader you are responsible for paying your own tax and ACC levy (this is a small annual amount that ACC sends you an invoice for that is determined by the type of business you run). Usually sole traders pay 30% tax so it is helpful to put this aside with each payment you receive throughout the year. At the end of the financial year (31st March) fill out an Individual Tax Return (IR3) through Inland Revenue.

	Ways to reduce the amount of tax you have to pay:Claim expenses that you have spent on your business (this is where book keeping comes in handy). Make sure you keep all the receipts too!
Accounting software might help you manage your record keeping and keep track of tax. Examples of these are Xero or Henry which allow everything to be stored online. Although you do still need to keep receipts and records for seven years, in case Inland Revenue audits you.

	
	What you need to know if you have multiple jobs:Making, exhibiting, and selling art doesn’t always cover the bills, so a lot of artists need multiple jobs as a way to get buy. This falls under freelance or gig work.&#38;nbsp; You need to pay tax on all of your jobs, and fill out an IR330C for each source of income at the end of the tax year. You are responsible for paying your tax on all sources of income as well as ACC levies, KiwiSaver, student loan, and child support (if these apply).

	Through CNZ you can apply for an Arts Grant between $5000 and $125,000 if you have success* and a proven track record in your artististic field.

CNZ has two funding schemes for artists and arts organisations working rurally or away from the major cities in Aotearoa. These are The Creative Communities Scheme and Ngā toi ā Rohe, Arts in the Regions.
CNZ funds a diverse range of projects and artforms, such as Community Arts, Craft / Art Object, Dance, Interarts, Literature,&#38;nbsp;Music,  Multidisciplinary Arts, Ngā Toi Māori, Pacific Arts, Theatre, and Visual Arts.
*CNZ offers funding for a wide range of art forms. For a visual artist, success means at least one public exhibition of a body of work that achieved a degree of critical or sales success. This can be a solo show or as part of a group exhibition, but not as part of a course of study. CNZ’s criteria of success is different for each type of art form that it supports.
